1. Scope
1.1 The following terms of use apply to the use of services and content ("platform") provided by Stephan Römer, Grüner Weg 73, 52349 Düren (hereinafter "Stephan Römer") via the website extensions.stephanroemer.de. As a visitor and user of the Platform ("User"), you confirm that you have read these Terms of Use and that you accept them.
1.2 Stephan Römer provides all services solely on the basis of these terms of use. Differing conditions of the user do not apply even if Stephan Römer does not expressly reject them and/or provides services and/or services without reservation despite knowledge of the conflicting and/or deviating conditions of the user.
2. Object of performance
2.1 Stephan Römer offers users the opportunity to add extensions (components, modules and plugins) for the CMS Joomla! to download. All extensions offered were created by Stephan Römer himself. A user account on extensions.stephanroemer.de is required to download free and pro versions.
3. User account registration and upgrade
3.1 In order to access and download the extensions, the user needs a user account on the platform.
3.2 Free versions: When registering for the free versions of all extensions, the following user information is required: first name, last name and a valid email address. In addition, the customer can freely assign a user name and password. The user account must be activated/confirmed by the customer himself. After submitting the registration form, he will receive an e-mail with a link through which he can activate the account. He then has access to all "Free Versions" offered.
3.3 Paid Versions / Pro Versions: Registration is also required to download a "Pro Version" via the platform. The following user information is required for this: first name, last name, e-mail address, address (street, house number), zip code, city and country. In addition, the customer can freely assign a user name and password. The user account must be activated/confirmed by the customer himself. After submitting the registration form, he will receive an e-mail with a link through which he can activate the account. He then gets access to the selected "Pro Version". If the customer is an entrepreneur or orders the order for a company, he must provide the correct company name and VAT ID in addition to the above information. An order via my website is only possible from an EU member state (see 6.7). If you would like to make a purchase from a non-EU country, please contact me.
3.4 Upgrade of the user account: If the user already has an active account on the platform, he can upgrade his account if he wants to download paid versions. To do this, he logs into his existing account and selects the "BUY" option for the corresponding "Pro Version". After successful payment he gets access to the corresponding "Pro Version". Access to all free extensions remains. Each "Pro Version" must be purchased individually. This can be done with a user account; multiple registrations are not necessary.
4. Prices, term and cancellation
4.1. Visiting the platform is basically free for the user. 4.2. Registering for an account to download "Free Versions" is also free. The term of the user account is unlimited; it will remain until you delete it or ask me to delete it. 4.3. There is a cost associated with registering for an account to download "Pro Versions" or upgrade. These may differ depending on the extension. The cost of accessing the Pro version can be found in the information for each extension. After successful payment you get access to the selected "Pro Version" for one year. You will also receive updates and premium support during this period. At the end of the year you have the option to extend the term. If you don't do this, access to the selected "Pro Version" will be blocked. However, you still have access to all free extensions.
4.4 All prices are net prices plus 19% sales tax.
4.5 If you are an entrepreneur or order a "pro version" on behalf of a company and your company is based in an EU country outside of Germany, the following applies: When registering, enter the full company name and a valid VAT. ID, the sales tax will not be calculated and the reverse charge procedure will apply.
4.6. If you order from a country outside the EU, you can only place your order as a private individual. German sales tax of 19% will be charged and listed on the invoice.
5. Payments and Invoices
5.1. Payments are accepted via the following providers:
(a) PayPal: An account with PayPal is recommended, but you can also pay with PayPal without registering by direct debit or credit card.
(b) Stripe: Here you can conveniently pay by credit card.
5.2 After successfully purchasing a "Pro Version" you will receive an invoice by email to the address provided within 48 hours. 5.3 Once an invoice has been issued, it cannot be corrected. Therefore, make sure that all information is correct. If you would like to enter an alternative billing address, you can do this in your user account under "Different billing address".

6. User Obligations
6.1 The user must enter the contract data requested by Stephan Römer in the registration form for the user login or in another way completely and correctly, if and to the extent that this is not marked as voluntary information.
6.2 The specification of artist names, pseudonyms or other imaginary designations within the framework of the specification of personal names is not permitted. It is also forbidden to provide third-party or otherwise inaccurate information when ordering.
6.3 If the data collected changes after the order has been placed, the user is obliged to update his profile to this effect immediately or to transmit the changed data to Stephan Römer in another way.
6.4 Furthermore, after logging into the user account, the user is obliged to enter the correct billing address in the corresponding field ("different billing address" if this differs from the data transmitted in the mandatory fields.
6.5 The user undertakes to keep his login password secret and to carefully secure access to his user account. The user must inform Stephan Römer immediately if there are indications that an account has been misused by a third party.
6.6 The user may not share his account with other people. In the event of an infringement, Stephan Römer reserves the right to immediately block the user account in question and to assert any claims for damages.
6.7 The user declares that he is only placing a chargeable order from an EU country. If you would like to receive an invoice as an entrepreneur, you must provide a valid VAT ID.
7. Rights and obligations of Stephan Römer
7.1 Stephan Römer makes the platform technically available, but does not guarantee users its constant availability.
7.2 Stephan Römer is entitled to restrict the user's access to the platform if the user violates one of his obligations under these terms of use or acts illegally in any other way. The user will be informed immediately of the restriction of use.
7.3 Stephan Römer is entitled to prohibit the use of the platform or to exclude users from use if the user violates one of his obligations under these terms of use or other obligations to a significant extent or repeatedly.
8. Liability
8.1 Stephan Römer is not liable for any damage suffered by the user, regardless of the legal reason, unless the damage is
(a) are based on a culpable breach of essential contractual obligations, i.e. obligations whose fulfillment is essential for the proper execution of the contract with the user and on whose compliance the user may regularly rely, whereby Stephan Römer's liability in this respect is limited to foreseeable damage or loss is limited;
(b) caused by gross negligence or intent on the part of Stephan Römer; and
(c) injury to life, limb or health, the Product Liability Act exist.
8.2 Stephan Römer assumes no liability for the functionality of the extensions offered. Liability and any claims for damages arising from the use of the extension (e.g. loss of data, faulty websites, etc.) are expressly excluded.
9. Support
9.1 Users who have purchased a paid "Pro Version" will receive Premium Support within one year. Stephan Römer offers the possibility to submit support requests via an online ticket system. Inquiries are usually answered within 12 hours on working days; it may take up to 24 hours to respond on weekends.
9.2 Users without premium support also receive support via the online ticket system. However, it may take up to 72 hours to respond. These requests will not be processed on weekends.
9.3 Stephan Römer reserves the right to limit premium support if
(a) the user behaves impolitely or illegally,
(b) the user is uncooperative in resolving the problem, or
(c) the user wants premium support although he has not purchased a "Pro Version".
10. Reimbursement of Payments
10.1 Stephan will refund payments already made to the user if
(a) the description of the selected extension does not correspond to the truth,
(b) the selected extension is not executable, or
(c) the download is not possible.
10.2 In all other cases, a refund of the amount paid is excluded.
11. Right of withdrawal (digital content)
11.1 The right of withdrawal for the purchase of a "Pro Version" expires as soon as the user downloads the offered digital content (extensions), which represents the beginning of the execution of the contract (see § 356 paragraph 5 BGB). The expiry of the right of withdrawal must be expressly agreed to by the user when purchasing a "Pro Version". In order to comply with legal requirements, all downloads of "Pro Versions" are logged.
12. Miscellaneous
12.1 The user is not entitled to assign rights and obligations from these terms of use without the prior written consent of Stephan Römer.
12.2 These Terms of Use represent the entirety of the regulations agreed between the parties with regard to the use of the platform.
12.3 The law of the Federal Republic of Germany applies exclusively to all legal disputes arising from or in connection with the platform between the user and Stephan Römer. The legal regulations on the restriction of the choice of law and the applicability of mandatory regulations, in particular of the state in which the user has his habitual residence as a consumer, remain unaffected.
12.4 If the user is an entrepreneur, the exclusive place of jurisdiction is Düren. The same place of jurisdiction applies if the user does not have a general place of jurisdiction in Germany, relocates his domicile or usual place of residence from within Germany after conclusion of the contract or his domicile or usual place of residence is not known at the time the action is filed. § 40 paragraph 2 ZPO remains unaffected.
12.5 The EU Commission offers the possibility of settling disputes on an online platform operated by it. You can find this platform under the external link ec.europa.eu/consumers/odr/. Stephan Römer does not take part in dispute settlement procedures before consumer arbitration boards.
12.6 If individual provisions of these terms of use are not legally effective or lose their legal validity due to a later circumstance, or if a gap is found in the terms of use, this shall not affect the legal effectiveness of the remaining provisions. If the user is not a consumer, the parties undertake to agree on an effective provision in place of the ineffective provision that comes as close as possible to the economic purpose of the ineffective provision.
